TERMS OF SERVICE

1. Acceptance of terms

Welcome to www.tagtag.com, an online community that connects people through networks of friends for communicating, sharing and making new friends. The TagTag service (“Service”) is operated by Inetis Ltd. By using the TagTag web site (the “Website”) you agree to be bound by these Terms of Service (this “Agreement”). In addition, if you wish to become a TagTag Member (“a Member”) and communicate with other Members or Users and make use of the TagTag service (the “Service”), you must read this agreement and indicate your acceptance of its terms by following the instructions in the Sign Up page, and checking the box labeled “I agree to TagTag's Terms of service.” This Agreement explains our obligations to you, and your obligations to us in relation to the TagTag Service. We reserve the right to modify these Terms at any time. Changes to these Terms will be posted in a revised version of these Terms on our web page at www.tagtag.com. By using the TagTag Services, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse the TagTag Website) or you are a “Member” (which means that you have registered with TagTag). The term “User” refers to a Visitor or a Member. You are only authorized to use the TagTag Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the TagTag Website and discontinue use of the TagTag Services immediately. If you wish to become a Member, communicate with other Members and make use of the TagTag Services, you must read this Agreement and indicate your acceptance during the Registration process.

2. Description of service

TagTag is service that provides a package of content and services for its Users. Service includes downloadable mobile entertainment content, such as ringtones, games, graphics, videos and Member web pages and the associated storage space for WAP pages in a dedicated area (http://www.tagtag.com). We encourage the free exchange of ideas within the limitations of this Agreement.

3. Your registration obligations

In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to:

  • provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (the “Registration Data”);
  • maintain and promptly update the Registration Data to keep it true, accurate, current and complete;
  • your use of the TagTag Services does not violate any applicable law or regulation. If you provide any information that is untrue, inaccurate, not current or incomplete, or TagTag has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, TagTag has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

4. Username and password

When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify TagTag.com immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

5. Non-commercial use by users

The TagTag Services are for the personal use of Users only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by TagTag.com. Illegal and/or unauthorized use of the TagTag Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the TagTag Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from profiles without notice and may result in termination of Users privileges. Appropriate legal action will be taken for any illegal or unauthorized use of the TagTag Services.

6. Proprietary rights in content on TagTag

  • TagTag does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, “Content”) that you post to the TagTag Services. After posting your Content to the TagTag Services, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. By displaying or publishing (“posting”) any Content on or through the TagTag Services, you hereby grant to TagTag a limited license to use, modify, publicly perform, publicly display, reproduce, enable embedding, and distribute such Content solely on and through the TagTag Services. Without this license, TagTag would be unable to provide the TagTag Services. This license will terminate at the time you remove your Content from the TagTag Services. The license does not grant TagTag the right to sell your Content, nor does the license grant TagTag the right to distribute your Content outside of the TagTag Services.
  • You represent and warrant that:
    • you own the Content posted by you on or through the TagTag Services or otherwise have the right to grant the license set forth in this section, and
    • the posting of your Content on or through the TagTag Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through the TagTag Services.
  • The TagTag Services contain Content of Users and other TagTag licensors. Except for Content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any content appearing on or through the TagTag Services.
  • The TagTag Services contain proprietary Content of Inetis Ltd. (“Proprietary Content”). Proprietary Content is protected by copyright, trademark, patent, trade secret and other laws. Inetis Ltd owns and retains all rights in the TagTag Content and the TagTag Services. TagTag hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the TagTag.com Content (excluding any software code) solely for your personal use in connection with viewing the TagTag Website and using the TagTag Services.

7. Removal of content and prohibited content

You understand and agree that we may review and delete any Content that you include in your profile, or otherwise Post on any area of the Website (which may include deleting your entire profile) that we, in our sole judgment, believe

  • violates this Agreement
  • might be offensive or illegal, or
  • might violate the rights of other User, harm, or threaten the safety of any other User.

You are solely responsible for the Content that you Post on the Website or the Service, or transmit to other Users. The following is a partial list of the kind of Content that is illegal or prohibited to post on or through the TagTag Services. Inetis Ltd reserves the right to investigate and take appropriate legal action against anyone who, in Inetis Ltd sole discretion, violates this provision, including without limitation, removing the offending communication from the TagTag Services and terminating the Membership of such violators. Prohibited Content includes, but is not limited to content that, in the sole discretion of TagTag:

  • patently offensive activity to the online community, such as Content that promotes racism, hatred or physical harm of any kind against any group or individual;
  • harasses or advocates harassment of another person;
  • exploits people in a sexual or violent manner;
  • contains nudity, violence, or offensive subject matter or contains a link to an adult website;
  • displays pornographic or sexually explicit material of any kind;
  • includes material that exploits people under the age of 18 in a sexual or violent manner;
  • provides any telephone numbers, street addresses, last names, URLs or email addresses;
  • provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  • advertising to any User to buy or sell any products or services through the TagTag Services. may not transmit any chain letters or junk email to other Users. It is also a violation of these rules to use any information obtained from the TagTag Services in order to contact, advertise to, solicit, or sell to any User without their prior explicit consent;
  • displaying an advertisement on TagTag pages, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the TagTag Services on behalf of that person;
  • promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
  • using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
  • selling or otherwise transferring your profile;
  • involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes
  • includes a photograph of another person that you have posted without that person's consent.

Even though all of the above Content is strictly prohibited, there is a chance that you might become exposed to such items while using the Website or the Service. If so, we will not in any way be responsible for any damages (to or from any party) related to any such exposure. Please see Sections 10 and 11 below for further limitations on our liability.

8. Copyrights trademarks and service marks of third party

You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information owned by another party without obtaining the prior written consent of the owner. Content is or may be protected under European Union and worldwide copyrights or other Intellectual Property Rights which are owned or licensed, in whole or in part, by Inetis Ltd. Content may not be manipulated, edited, reproduced, performed, republished, posted, transmitted, sold, transferred or otherwise distributed, exploited in any manner whatsoever, or used on any other service, website or other networked computer environment without our prior written consent or as provided for in the restrictions applicable to the relevant User Submission. If you download, print, or otherwise reproduce a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein.

If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide Inetis Ltd Copyright Agent the following information:

  • an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
  • a description of the copyrighted work or other intellectual property that you claim has been infringed;
  • a description of where the material that you claim is infringing is located on the site;
  • your address, telephone number, and email address;
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law;
  • a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

9. Users disputes

You are solely responsible for your interactions with other TagTag Users. TagTag reserves the right, but has no obligation, to monitor disputes between you and other Users.

10. Disclaimers

TagTag is not responsible for any incorrect or inaccurate Content posted on the TagTag Website or in connection with the TagTag Services, whether caused by Users of the Website, Members, our advertisers or corporate partners, or by any of the equipment or programming associated with or utilized in the operation of the Website or the Service. The Service may contain links to third-party websites or services that are not owned or controlled by Inetis Ltd. Inetis Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. In addition, Inetis Ltd will not and cannot censor or edit the content of any third-party website or service. By using the Service, you expressly relieve Inetis Ltd from any and all liability arising from your use of any third-party website or services or third party owned Content. Accordingly, we encourage you to be aware of when you leave the Service, and to read the terms and conditions and privacy policy of any third-party website or service that you visit. Inetis Ltd is not responsible for the conduct, whether online or offline, of any User of the TagTag Services. Inetis Ltd assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User or Member communication. UNDER NO CIRCUMSTANCES WILL WE BE RESPONSIBLE FOR ANY LOSS OR DAMAGE, INCLUDING PERSONAL INJURY OR DEATH, RESULTING FROM ANYONE'S USE OF THE WEBSITE OR THE SERVICE, ANY CONTENT POSTED ON THE WEBSITE OR TRANSMITTED TO MEMBERS OR OTHER USERS, OR ANY INTERACTIONS BETWEEN OR AMONG MEMBERS OR OTHER USERS OF THE WEBSITE, WHETHER ONLINE OR OFFLINE. Inetis Ltd cannot guarantee and does not promise any specific results from use of the TagTag Services. The Website and the Service are provided “AS-IS” and, except as otherwise prohibited by applicable law, we expressly disclaim any warranty of any kind, including, but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. TagTag, its subsidiaries, and its licensors do not warrant that the content is accurate, reliable or correct. We cannot guarantee and do not promise any specific results from use of the Website or the Service. No advice or information, whether oral or written, obtained by you from us, or from or through the Website or the Service shall create any warranty not expressly stated herein.

11. Limitations of liability

I no event shall Inetis Ltd be liable you or any third party for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, that result from the use of, or inability to use, this service. Under no circumstances will Inetis Ltd be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorized access or use of the service or your account or the information contained therein.

12. Indemnity

You agree to defend, indemnify and hold Inetis Ltd harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, arising out of or relating to:

  • Your use of the Website or the Service (including the Posting by you of any Content on the Website) in violation of this Agreement;
  • Any other breach of this Agreement by you; or
  • Any breach of your representations and warranties set forth above;
  • Your violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights;
  • Your violation of any law, rule or regulation of the United States or any other country;
  • Any claim for damages that arise as a result of any of your User Submissions or any that are submitted via your account; or
  • Any other party's access and use of the Service with your unique username, password or other appropriate security code.

13. Disputes

If there is any dispute about or involving the TagTag Services, you agree that the dispute shall be governed by the laws of Slovenia and European Union, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the courts of Slovenia.

14. Termination

This Agreement shall remain in full force and effect while you use the TagTag Services or are a User. You may terminate your Membership at any time, for any reason, by following the instructions on the Member's Account Settings page. TagTag may terminate your Membership at any time, without warning. Although this Agreement may be terminated by you or us at any time and for any reason, the terms of the following sections of this Agreement will survive any such termination, and you and we will continue to be bound by such terms indefinitely: Section 6 (Proprietary Rights in Content on TagTag), Section 9 (User Disputes), Section 10 (Disclaimers), Section 11 (Limitations of Liability), Section 12 (Indemnity), Section 13 (Disputes), Section 14 (Termination) and Section 15 (Statute of Limitations).

15. Statute of limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

16. Other

This Agreement is accepted upon your use of the TagTag Website or any of the TagTag Services and is further affirmed by you becoming a User. This Agreement constitutes the entire agreement between you and Inetis Ltd regarding the use of the TagTag Services. The failure of Inetis Ltd to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.


PRIVACY POLICY

1. Information collection & use of collected information

Inetis Ltd collects user submitted information at sign-up. TagTag also logs non-personally-identifiable information including IP address, profile information, aggregate user data, and browser type, from Users of the site (“Collected Information”). This data is used to manage the website, track usage and improve the website services. This non-personally-identifiable information may be shared with third-parties to provide more relevant services and advertisements to members. User IP addresses are recorded for security and monitoring purposes for limited time.

Users within a personal network communicate on TagTag with each other through TagTag service, without disclosing their email addresses. Users' full names are never directly revealed to other members.

Any personal information or User Submissions that You voluntarily submit to be disclosed online (on discussion boards or forums, in messages and chat areas, on photos, etc.) becomes publicly available and can be collected and used by other Users, who may forward this personal information or User Submissions to other websites or people, making it available to the general public, and therefore such information and User Submissions cannot be protected as Personally Identifiable Information. In addition, your username may be displayed to other Users when you upload or post Content and other Users may contact you through messages and comments.

We may use your email address for administrative purposes, such as notifying you of major Service changes and news, or for other customer service purposes. We use Collected Information, such as anonymous Service use data, cookies, and IP addresses, to improve the quality and design of the Service.

We may also use a user's email address to send updates, a newsletter or news regarding the Service.

When Inetis Ltd disclose information

Inetis Ltd may release Collected Information if required to do so by law, or in the good-faith belief that such action is necessary to comply with laws (such as U.S. Copyright Law), or respond to a court order, subpoena, or search warrant. It may be necessary to share Collected Information in order to investigate, prevent, or take action regarding suspected or actual illegal activities, including but not limited to, fraud, potential threats to public safety or the physical safety of any person, violations of our Terms of Use, or as otherwise permitted by law.

Inetis Ltd also reserves the right to disclose Collected Information that Inetis Ltd believes is appropriate or necessary to enforce our Terms of Use, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to protect the security or integrity of our Service, and to exercise or protect the rights, property, or personal safety of TagTag, our Users or others.

2. Cookies information

When you visit the Service, we may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that identifies your web browser. TagTag uses cookies to store Users' preferences and to record session information, for purposes including ensuring that Users are not repeatedly offered the same advertisements and to customize newsletter, advertising, and Web page content based on browser type and user profile information.

We do not link the information we store in cookies to any personally identifiable information you submit while on our site. You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set (each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences) however, you must enable cookies from TagTag in order to use most functions of the Service. However, if you don't, some features of the Service may not function properly, including time saving features such as automatic log-in to the Service after your initial registration.

3. Third-party advertises

Inetis Ltd may allow other companies to serve advertisements on the Service and contains links to sites. These third-party advertisers use technology to send, directly to your browser or mobile phone, the advertisements and links that appear on the Service. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize the advertising content. Inetis Ltd is not responsible for the privacy policies and/or practices on other sites. When linking to another site a User should read the privacy policy stated on that site. Our privacy policy only governs information collected on TagTag.

Advertisers' use of cookies is subject to their own privacy policies, not the TagTag Privacy Policy.

4. Blogs, forums, photos, videos

Please be aware that whenever you voluntarily post public information to blogs, forums, photos, videos, etc. that information can be accessed by the public and can in turn be used by those people to send you unsolicited communications.

5. International users

The Service is hosted in Slovenia, Europe. If You are accessing the Service from the USA, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from European Union laws, please be advised that through your continued use of the Service, which is governed by EU law, this Privacy Policy, and our Terms of Use, You are transferring your personal information to the European Union and You consent to that transfer.

6. Changes to privacy policy

TagTag may update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site.
